General Terms and Conditions

1. Conditions for Concluding the Accommodation Contract
1.1 Accommodation at PenzionMalý is provided on the basis of an accommodation contract concluded under the provisions of § 2326 et seq. of Act No. 89/2012 Coll., the Civil Code, under which the accommodation provider grants the guest temporary accommodation for the agreed period or for the time arising from the purpose of accommodation in the designated facility, and the guest (hereinafter also referred to as the "guest") undertakes to pay the provider for the accommodation and related services within the time limits set by these General Terms and Conditions (hereinafter also referred to as the "contract").
1.2 The accommodation contract is always concluded in writing. For fulfilling this form requirement, a written confirmation of an order or reservation is sufficient.
2. Conclusion of the Contract, Reservation
2.1 The guest is obliged to submit the accommodation order to the provider in writing or make a reservation by telephone and subsequently confirm it in writing. A written reservation or written confirmation of a telephone reservation, as referred to in the previous sentence, means an order made through the reservation form, by e-mail to the provider at info@penzionmaly.cz, or by mail sent to the guesthouse address stated in the header of these terms and conditions.
2.2 Once the provider receives the written order or written confirmation of the reservation from the guest, the provider will issue an invoice or an online payment link in the amount of 100% of the expected accommodation price and send it to the guest at the address provided in the order pursuant to Section 2.1. The guest is obliged to pay this amount within the time limit and under the conditions stated in the invoice or via the online payment gateway.
2.3 The accommodation contract is concluded only once two conditions are cumulatively fulfilled: the delivery of the written order or written confirmation of reservation to the provider, and the receipt by the provider of the payment representing the accommodation price.
2.4 The payment gateway provider is Comgate, a.s., Gočárovatřída 1754 / 48b, Hradec Králové, tel.: +420 228 224 267, e-mail: platby-podpora@comgate.cz.
3. Cancellation of Reservation, Withdrawal from the Contract, Cancellation Policy
3.1 If the guest does not pay the amount according to Section 2.2 within 3 days from placing the order, the reservation is cancelled after the expiry of this three-day period.
3.2 The guest is entitled to withdraw from the accommodation contract before the day of arrival, even without giving a reason. This must be done in writing, either to the guesthouse address stated in the header of these terms and conditions, or by e-mail to info@penzionmaly.cz. Cancellations must always be submitted in writing; telephone cancellations will not be accepted. In such cases, the provider is entitled to charge the guest a cancellation fee, determined by the length of time between the cancellation date (the decisive date being the day the written cancellation is delivered to the provider) and the first day of the stay, as follows:
Standard rate:
- Cancellation up to 30 days before arrival: handling fee CZK 10
- Cancellation 29–8 days before arrival: 40% of the accommodation price
- Cancellation 7–3 days before arrival: 70% of the accommodation price
- Cancellation 72 hours or less before arrival: 100% of the accommodation price
Flexi rate:
- Cancellation up to 7 days before arrival: handling fee CZK 10
- Cancellation 6–3 days before arrival: 50% of the accommodation price
- Cancellation 72 hours or less before arrival: 100% of the accommodation price
If the guest cancels the stay but provides a full-value replacement, PenzionMalý does not charge any cancellation fees.
3.3 If the guest does not arrive for accommodation within 24 hours of the agreed check-in time, the provider is entitled to withdraw from the accommodation contract and also to charge the guest a cancellation fee of 100% of the accommodation price. This does not apply if the guest has notified the provider of a later arrival in advance, but no later than 1 day before the planned arrival, either by telephone or in writing. The form of such notification is subject to the provisions of Section 2.1 accordingly.
4. General Accommodation Rules
4.1 The guest has the right to use the space reserved for accommodation, as well as the common areas of the guesthouse, and to make use of services connected with the accommodation.
4.2 Upon arrival, the guest collects the key to the room and to the entrance of the guesthouse (hereinafter collectively referred to as the "keys") from the key box located at the entrance. The guest is obliged to prevent loss, destruction, damage, or making the keys accessible to third parties who are not direct participants in the accommodation contract concluded between the guest and the provider. Possible penalties for loss, destruction, damage, or unauthorised access to the keys are set out in the accommodation contract.
4.3 The guest is obliged to:
- Familiarise themselves with and comply with these General Terms and Conditions
- Pay the price of accommodation according to the valid price list
- Properly use the premises designated for accommodation, maintain order and cleanliness in all such premises
- Ensure cleanliness in all accommodation areas
- Protect the equipment from damage
- Immediately report any damage caused by the guest or accompanying persons in the guesthouse premises. For intentional damage, pollution, or loss of equipment, the guest is obliged to pay adequate compensation determined by the operator
- From 22:00 to 07:00, behave in a manner that does not disturb other persons with excessive noise
- Upon leaving the room, close water taps, turn off lights, switch off electrical appliances not in use during absence, and close the windows¨
4.4 The guest may not, without the provider's consent:
- make substantial changes in the premises (move furniture, relocate equipment, etc.)
- remove any equipment or furnishings from the premises
- use their own appliances in the room, except for small devices used for personal hygiene or office work
- transfer the premises to another person
- receive visitors in the accommodation premises (visitors may only be received in the common areas)
- state the address of the guesthouse as their business address;
- Keep animals in the guesthouse
4.5 Furthermore, in the premises designated for accommodation, the guest may not:
- Carry, store, or use weapons, ammunition, or explosives
- Keep, produce, or store narcotics, psychotropic substances, or poisons, unless prescribed by a doctor
- Smoke anywhere inside the building. For violation of the smoking ban, a fine of at least CZK 1,000 will be charged, as well as additional compensation for any damage as determined by the provider
- Use an open fire
4.6 The guesthouse does not normally provide daily room cleaning or daily towel replacement; however, for longer stays, cleaning can be arranged by agreement
5. Liability of the Provider for Guests' Belongings and Safe Operation
5.1 Upon request, the provider will accept for safekeeping money, jewellery, or other valuables. The guesthouse may refuse if the items are dangerous or disproportionate in value or size. Items must be handed over in a closed or sealed container
5.2 The provider does not assume liability for loss of valuable items or large sums of money; guests are therefore advised to use the safe located in the non-public part of the guesthouse, in accordance with Section 5.1
5.3 Claims for damages to the guest's belongings must be submitted within 7 days after discovering the damage. Compensation will not be provided if the damage was caused by the guest or their companions.
5.4 Employees of the guesthouse, or persons authorised by them, are personally responsible for the safe operation of the facility; therefore, guests must follow their instructions
5.5 Accommodation will not be provided to persons suffering from infectious diseases, skin parasites, or to persons under the influence of alcohol or narcotics
6. Safety, Guest's Liability for Damages
6.1 The provider may require a security deposit of up to CZK 4,000 per room before check-in. The deposit is refundable upon departure, either in full or reduced as per Section 6.3.
6.2 The guest must act in such a way that does not cause unjustified harm to the freedom, life, health, or property of others
6.3 If the guest causes damage to the provider's property, the damage will be covered from the deposit under Section 6.1. If the damage exceeds the deposit, the guest is obliged to pay the difference
7. Departure from the Guesthouse / End of Stay
7.1 The guest is obliged to vacate the room by 11:00, unless otherwise agreed
7.2 The guest must lock the room and drop the keys into the red box located at the entrance door of the guesthouse, marked "check-out keys / klíče / klucze," unless otherwise agreed
8. Information on Personal Data Processing
8.1 The guesthouse processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR)
8.2 For accommodation purposes, the following personal data/categories of personal data are processed: name, surname, date of birth, residence, ID card or passport number, and, where applicable, telephone number and e-mail address—based on information provided from public sources/other sources/by the guest
8.3 Personal data will be processed manually and automatically, directly by authorised employees of the guesthouse and by processors authorised by the guesthouse under data processing agreements
8.4 The list of entities/categories of recipients to whom guest data may be disclosed is determined in accordance with Czech law
8.5 Personal data will be processed for 6 years under Act No. 565/1990 Coll., on Local Fees, and Act No. 326/1999 Coll., on the Residence of Foreign Nationals in the Czech Republic, and for 10 years for tax purposes
8.6 Guests have the right to access their personal data processed by the guesthouse, to request correction or erasure, or to restrict processing, as well as the right to object to processing
8.7 Guests also have the right to obtain personal data concerning them that they have provided to the guesthouse. Upon request, the guesthouse will provide the data subject with this information without undue delay in a structured, commonly used, and machine-readable format, or will transfer it to another clearly designated controller at the guest's request. This right does not apply to personal data not processed automatically
8.8 If a guest believes their personal data is being unlawfully processed, they may file a complaint with the supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (www.uoou.cz)
8.9 The guest hereby consents to the processing and storage of their personal data by the provider, within the scope of the data provided, for the purpose of accommodation services and guest records pursuant to Act No. 565/1990 Coll., on Local Fees, and Act No. 326/1999 Coll., on the Residence of Foreign Nationals in the Czech Republic and amending certain laws. Further obligations of both the guest and the provider regarding record-keeping are stipulated by the above-mentioned legal regulations.
